I, the personal data subject (the "User"), acting freely, of my own will and in my own interest, in accordance with Articles 6 and 9 of Federal Law of the Russian Federation No. 152-FZ "On Personal Data", hereby give Sole Proprietor Vladimir Leonidovich Rabchanov, OGRNIP 317470400018418, INN 471009214205, St. Petersburg, Russia, email: admin@upmob.ru (the "Operator"), my consent to the processing of my personal data on the terms set out below (the "Consent").
1. How the consent is given
1.1. The Consent is deemed given when the User ticks the checkbox "I have read the Personal Data Processing Policy and give my consent to the processing of my personal data" and clicks the submit button of a form on the website https://www.upmob.ru (the "Website").
1.2. Ticking the checkbox and submitting the form are implicative actions that unambiguously express the User's will. The Consent is specific, subject-defined, informed, conscious and unambiguous.
1.3. The date and time the Consent is given are recorded by the Operator together with the form data.
2. Personal data covered by this consent
2.1. The Consent covers the following personal data provided by the User in the Website forms:
· last name, first name (if provided by the User);
· email address;
· phone number;
· messenger username (Telegram, WhatsApp);
· link to the promoted app, website or other object and related information provided by the User in the form;
· data collected automatically when using the Website: IP address, browser and operating system details, cookies.
2.2. Special categories of personal data (race, ethnicity, political opinions, religious or philosophical beliefs, health, etc.) and biometric personal data are not processed.
3. Purposes of processing
3.1. The personal data is processed for the following purposes:
· handling the User's request and contacting the User via the provided contact details;
· consulting on the Operator's services, preparing an individual quote and commercial proposal;
· conclusion and performance of a service agreement for the services offered on the Website;
· compliance with the legislation of the Russian Federation.
3.2. Informational and promotional messages (news, promotions, special offers) are sent to the User only with a separate consent expressed by ticking the corresponding optional checkbox in the form (Section 7 of this Consent).
4. Actions with personal data and processing methods
4.1. The Consent covers the following actions (operations): collection, recording, systematization, accumulation, storage, clarification (updating, modification), retrieval, use, transfer (provision, access), blocking, deletion and destruction of personal data.
4.2. Processing is carried out both with the use of automation tools (the Website's information systems) and without them.
4.3. Personal data is not disseminated (not disclosed to an unlimited number of persons). Data is transferred to third parties only in the cases and in the manner provided for in Section 7 of the Privacy Policy (payment services, technical contractors bound by confidentiality obligations, authorized state bodies upon lawful requests). No cross-border transfer of personal data is performed.
4.4. Personal data is stored on servers located in the Russian Federation.
5. Duration of the consent
5.1. The Consent is effective from the moment it is given until the purposes of processing set out in Section 3 are achieved or until it is withdrawn by the User, whichever occurs first.
5.2. Personal data retention periods are defined in clause 6.5 of the Personal Data Processing Policy.
6. Withdrawal of the consent
6.1. The User may withdraw the Consent at any time by sending a written request to the Operator's email admin@upmob.ru, specifying the personal data whose processing should be stopped and the contact from which the form was submitted.
6.2. Upon receiving the withdrawal, the Operator stops processing the personal data and destroys it within 30 days, except for data the Operator is required to continue processing by law.
6.3. Withdrawal of the Consent does not affect the lawfulness of processing carried out before the withdrawal.
7. Consent to receive informational and promotional messages
7.1. By ticking the separate optional checkbox "I'd like to receive UpMob news and special offers", the User, in accordance with Article 18 of Federal Law No. 38-FZ "On Advertising" and Article 15 of Law 152-FZ, consents to receiving informational and promotional messages from the Operator via the provided contact details (email, phone, messengers).
7.2. This consent is voluntary, does not affect the ability to submit the request and may be withdrawn at any time via the unsubscribe link in an email or by contacting admin@upmob.ru.
8. Final provisions
8.1. Personal data is processed in accordance with the Personal Data Processing Policy and the Privacy Policy published on the Website.
8.2. The User's rights as a personal data subject under Chapter 3 of Law 152-FZ (including the right to obtain information about the processing, and to have the data clarified, blocked or destroyed) are exercised in the manner set out in Section 8 of the Personal Data Processing Policy.
